These Terms of Use ("Terms") govern your access to and use of ShortFormData ("we," "us," or "our") services, including any related software, applications, websites, or content provided by ShortFormData (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you agree to comply with and be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

3. Account Registration

To use certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process, and to keep that information up to date. Payments are due according to the subscription plan you selected, and failure to pay may result in suspension or termination of your account.

7. Data Ownership and Privacy

You retain ownership of any data you upload to the Service ("Customer Data"). However, by using the Service, you grant us a license to process and store your Customer Data to provide the Service.

Our Privacy Policy governs the collection, use, and disclosure of your personal data. You agree to review the Privacy Policy before using the Service.

8. Intellectual Property

The Service, including all software, designs, text, images, and other content, is the property of ShortFormData (a venture from Value Iteration Technologies) or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

9. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we believe you have violated these Terms. Upon termination, you must cease all use of the Service, and we may delete your account and Customer Data in accordance with our Privacy Policy.

10. Limitation of Liability

To the fullest extent permitted by law, Value Iteration Technologies will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, revenue, profits, or business opportunities arising out of or in connection with your use or inability to use the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties, express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. We do not guarantee that the Service will be error-free, secure, or uninterrupted.

12. Indemnification

You agree to indemnify, defend, and hold harmless Value Iteration Technologies, its affiliates, employees, agents, and licensors from any claims, losses, or damages arising out of your use of the Service or violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms of Use will be governed by and construed in accordance with the laws of the United Arab Emirates ("UAE"). Any disputes arising out of or in connection with these Terms, including disputes regarding their validity, interpretation, or enforcement, shall be subject to the exclusive jurisdiction of the courts of the relevant UAE Free Zone where our entity is registered.

In the event of a dispute, you agree to first attempt to resolve the matter through informal negotiations. If the dispute cannot be resolved amicably within 30 days, it will be referred to arbitration under the rules of the Dubai International Arbitration Centre (DIAC), in the English language, with the seat of arbitration in the specific Free Zone, as applicable.

14. Changes to the Terms

We reserve the right to modify or update these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Your continued use of the Service after the changes are made constitutes your acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
